This chapter discusses the right to elementary education, which by all universal standards is considered to be a basic human right to be freely available to every human being. It provides the background of the right to education and describes the recognition of this right in the respective constitutions of India and China. The right to education was introduced in the current 1982 Constitution of the People's Republic of China (PRC). In order to determine whether the right to education in India and China in practice resemble the relevant constitutional and legal provisions on paper, people need to consider ground realities as to the implementation and protection of the right. Even regarding the type of education provided, there are differences between the approaches adopted in India and China: in India it is liberal education, while in China greater emphasis is placed on imparting socialist and moral values. © 2016 selection of editorial material, Surya Deva.
